Madison County, Ohio, Court of Common Pleas, J. Costello (2018). Defendant was stopped after an alleged traffic violation on the interstate highway. After a search of questionable constitutionality, a Preliminary Hearing was held December of 2016, and charges of Aggravated Trafficking in Drugs (40 pounds of marijuana) were bound over to the County Grand Jury. Based upon arguments of counsel in negotiations regarding the violation of the Defendant’s Fourth, Fifth, and Sixth Amendment rights, the State ultimately declined to prosecute, and the charges were Dismissed upon the State’s Motion.
